Terms of use

1. These Terms of use (“Terms”) apply between The Newbie Guide to Sweden AB with company registration number: 556934–4905 (hereinafter referred to as “The Newbie Guide”, “we”, “us”, “our”) and the person (hereinafter referred to as the “User” or “you”) who visits thenewbieguide.se (the “Website”). The User and The Newbie Guide are jointly referred to as “Parties” and individually as “Party“.
2. You agree to these Terms when you visit the Website and/or publish a comment on the Website, and you undertake an obligation to comply with these Terms. If you do not agree to be bound by these Terms, please do not use the Website.
3. We may amend these Terms whenever we want without prior notice, and the updated version is always publicly available on the Website at thenewbieguide.se/terms-of-use.

1. All references to “Personal Data“, “Processing“, “Data Subject“, “Personal Data Breach“, “Sub-processor“, “Supervisory Authority” and any other capitalized terms not defined herein shall have the same meaning in these Terms as stated in article 4 of the GDPR.
2. GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

1. The Website: We shall have the right to, at any time and without prior notice, discontinue with the Website services, freely change the design, layout, content and similar. This also applies if such changes entail a changed user experience.
2. Content published by a user: The Newbie Guide has no responsibility or liability for any material or content that is posted by a user. The content that a user may publish on the Website does not necessarily reflect the opinions or policies of The Newbie Guide. The Newbie Guide is not in any way responsible for the reliability or accuracy of the published content provided by a user.
3. Editorial rights: We have the right (but not the obligation) to monitor any publicly posted material for inappropriate and illegal contents posted by the users. If you make a comment on any post on the Website, we have the right (but not the obligation) to, without prior notice, edit the content of the comment, delete or remove any content or published material that we, in our sole judgment, deem to be inappropriate or not in compliant with Agreement, applicable law or regulation, or which might be offensive, illegal or that might violate the rights, harm, or threaten the safety of other users. 
4. Statistics: We have the right to anonymize all data contained on the Website. The anonymization must be made in such a way that it is not possible to convert back to Personal Data. All ownership rights to anonymized data belongs to us, who has the right to use and store such data without restriction in time. We also have the right to use all data on the Website for, for example, statistical and evaluation purposes and for the development of the Website or our services.
5. Maintenance: We have the right to temporarily suspend access to the Website for maintenance and service purposes, to protect the Website from unauthorized attacks or to take other measures that are required for technical, operational or safety reasons. We do not need to give a prior notification regarding when such interruptions may occur. Lack of access to the Website due to interruptions, technical errors or other interruptions does not entitle anyone to damages or other compensation. The Newbie Guide cannot be held responsible for technical faults, viruses, availability, other faults attributable to Websites functionality or similar.
6. No guaranties: The Website is constantly updated. There is no guarantee that the Website will be free from various disruptions or other technical complications. We shall, to the best of its ability and within a reasonable time, remedy any reported errors or defects on the Website. We do not give any guaranties or warranties regarding for example the accuracy of the content on the Website and cannot be held responsible for any content that is not updated, accurate or similar. 
7. Subcontractors: The Newbie Guide have the right to use subcontractors to fulfill The Newbie Guide’s obligations under these Terms. In such cases, we shall ensure that necessary regulations regarding, for example, the Process of Personal Data are contained in a data processing agreement between us and the Sub-contractor.

1. Compliance with the Terms: The User shall comply with the Terms and instructions regarding the use of the Website at all times. The User is solely responsible for all activities undertaken by the User. 
2. Applicable law: You hereby agree to at all times abide by all applicable laws and regulations (national and international) laws and regulations as well as these Terms. 
3. Comments on the Website: You are responsible for the content and material that you publish on the Website. You provide your name and e-mail in connection with your comment being published on the Website. Your name and the content of the comment will be visible to the public upon publication, but not the email address that you have registered in connection with publication of the comment. 
4. Prohibited content: You may not publish comments on the Website that may be perceived as offensive or outrageous, such as, for example, portrayals of hateful, racist, threatening or pornographic content or that call for acts of violence or incitement against people. The comment shall not contain political or religious propaganda or criminal activity such as drug dealing, trafficking, fraud, sending of harmful computer files or intrusion of copyright or patent rights. You are not allowed to include any street addresses, photograph of another person, telephone numbers, e-mail addresses or any other Personal Data of that kind without consent from that individual. It is also prohibited to involve the transmission of junk mail, chain letters, or unsolicited mass mailing or spamming, commercial activities and/or sales without our prior consent such as advertising.
5. Request deletion of your published comment: You are responsible for providing your accurate e-mail in connection with publishing of a comment on the Website. If you wish to delete a comment that you have published, please contact us by email and provide the same email that you provided when you published the comment.
6. Warrants: You warrant that the Website shall only be used in accordance with these Terms, applicable legislation and our instructions. You also warrant not to misuse any data or information that may be retrieved from the Website, and that all content posted by you on the Website does not violate the rights of any third party, including, but not limited to, infringing intellectual property rights.
7. Indemnification: You may not use the Website for any unlawful or unauthorized purpose or in such a way that we, or anyone else, is affected by inconvenience or damage. You agree and undertake to indemnify The Newbie Guide in respect of any liability or any costs, loss of profits, loss of data, or consequential losses arising from a breach by you of any of these Terms, applicable law or third-party rights.

The Newbie Guides content: We own the domain of the Website, the brand “The Newbie Guide to Sweden”, our logo and the articles posted on the Website, and such materials are protected by copyright and trademark laws. You may not copy, modify or use, any material from this Website including the underlying code and software. You are only allowed use the Website and the content for your own personal, non–commercial use. This amounts to viewing the Website and printing off individual pages or sections for personal use. You may also repost any published articles from the Website on your social media accounts, but shall immediately at our request delete any repost of our content or Website.
2. User Content: Any content that you provide to us, such as for example posted comments on the Website, is subject to a fully paid, royalty-free, perpetual, non-exclusive, unrestricted, worldwide license allowing us to use, modify, copy, translate, reproduce, store, sublicense, adapt, transmit, publicly perform or display and distribute any such content on and through the Website or through others that are partners to us. You hereby warrant that you have the right to grant us the above-described license regarding the content and that the content does not infringe upon any third-party intellectual property or other rights. This license is valid during the time that the content is published on the Website and the license will end when the content is removed from the Website. However, the content may be stored in a back-up copy of the servers for up to three (3) months after the deletion of the content from the Website.

1. User’s actions: The reliance on information published on the Website is at the User’s own risk. We cannot be held responsible for how the User chooses to make use of the information available through the Platform. Users are solely and fully responsible for their actions, including any failure to act. Users are responsible for ensuring that the material that User submits to us or publishes on the Website does not violate applicable laws, regulations and/or third-party rights.

Third-party information: The Website may contain information that a third party has published, or that is provided by a third-party (such as users, bloggers, cooperation partners, affiliates etc.). We have no control over such third-party information and do not guarantee its accuracy or that it will continue to be available on the Website. We are neither directly or indirectly liable for any damage or loss related to certain information or the absence of certain information from third parties. 
3. Other websites: We, users, bloggers or other third parties may provide links to other external websites (other websites) through the Website, and the Website may be linked to or from other websites that are not maintained by us. We have no control over such other websites and do not in any respect control any information, products or services offered by such other websites. We are not responsible for the availability or for any content, advertising, products or other materials available through such other websites. We cannot be held liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any content, goods or services available on or through any third-party website. 
4. No guarantees: You use the Website at your own risk and of free will. The Website is provided without any guarantees of any kind. By using the Website, Users agree that we do not make any representations or warranties of any kind, neither expressed or implied.

Disclaimer: We hereby expressly disclaim, to the fullest extent permitted by applicable law, all warranties, express or implied, of any kind whatsoever and from liability for, any and all, direct and indirect damages and/or losses caused user or any third party in connection with the use of or obstacles to the use of the Website, regardless of how the damage occurs and whether the damage is caused by negligence, breach of contract, applicable law or otherwise. In addition, we shall not be responsible for the failure of performance of the Website; the accuracy, quality or nature of information obtained through the Website; nor the consequences arising from or related to any viruses transmitted through the Website, or any liability, costs, loss of profits or consequential losses arising from your use of, or inability to access the Website.

1. We Processes Personal Data in accordance with the applicable General Data Protection Regulation (GDPR) and are responsible for all Personal Data that is submitted to us by you. We also engage Sub-processors in order to provide, maintain and develop the Website, such as web developer, email provider, hosting provider, business system etc. You hereby agree that we have the right engage Sub-processors to fulfill the obligations under the agreement between us. This means that we may disclose Personal Data to engaged Sub-processors, in order to fulfill our obligations under the Terms, applicable legislation, legal obligations, as well as to safeguard our legal interests and to detect and prevent technical or security issues with the Website.

We are exempt from liability and other liability for damage or failure to act, if it is due to an obstacle beyond our control which we could not reasonably have expected and whose consequences we could not reasonably have avoided or overcome, including but not limited to such as epidemics, pandemics, government decision, wars, natural disasters, lockouts or other labor conflicts, fires, interruptions in energy supply, and interruptions in the operation of electronic data processing caused by the above. The same applies if a Sub-processor or subcontractor to us is affected by obstacles referred to in this provision.

If any term, provision, covenant or restriction of these Terms is held by a court of competent jurisdiction or other authority to be invalid, void or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties, the remainder of the terms shall remain in full force and effect and shall in no way be affected, impaired or invalidated.

1. These Terms shall be governed by and construed in accordance with the laws of Sweden. Any dispute, controversy or claim arising out of or in connection with the Terms shall be settled by a Swedish court, and the Stockholm District Court shall be the court of first instance.
